This Terms of Service Agreement (“Agreement” or “Terms”) is a legal agreement between you („User”, „he/she”) and TOP APP Sp. z o.o. („Provider”, “we”, or “us”)
By accessing or using the VibMe application, you acknowledge that you have read, understood and agree to be bound by these Terms. If you do not agree to these Terms, do not access or use application. These terms will automatically apply to you after you download and using VibMe application – you should make sure therefore that you read them carefully before using the app.
VibMe application are not available to, and shall not be accessed or used by, persons under the age of 18.BY ACCESSING OR USING application, YOU REPRESENT AND WARRANT THAT YOU ARE AT LEAST 18 YEARS OF AGE.
The Services are also not available to, and shall not be accessed or used by, any users previously blocked or otherwise banned from accessing or using the application.
Provider of application, provide communication paths and channels prepared for connect users with other users. Provider does not exert any control over the users you interact with. Provider has no obligation to monitor these communication channels but may, in its discretion, do so in connection with providing and managing the services and system. Termination or suspend may be happen anytime without notice, for any reason in its sole discretion. You acknowledge and agree that any user content, including without limitation text chats and video chats, is not created, endorsed or controlled by Provider. Provider is not responsible for information or content that you choose to share within or through the services nor is Provider responsible for the content or actions of other users of the services. You are solely responsible for your interaction with other users of the VibMe application and other parties that you come in contact with through the services. To the fullest extent permitted by applicable law. Provider hereby disclaims any and all liability to you or any third party relating to your use of the services. You acknowledge and agree that use of the VibMe application, including your interactions with other users, may carry inherent risk and by accessing and using the services, you choose to assume those risks voluntarily. You assume full responsibility for your use of the VibMe application, including your interactions with other users in fullest extent permitted by applicable law.
The VibMe application provide pay subscriptions. Payment will be charged to your Appstore Account after you confirm Purchase. Your subscription automatically renews unless auto-renewal is turned off at least 24 hours before the end of the current subscription. You can manage your subscription and switch off the auto-renewal by accessing your App Store account settings after purchase. To cancel your subscription, turn off auto-renew and wait for your subscription to expire.
Provider will not take responsibility for many functions of the VibMe application will require the app to have an active internet connection WIFI or mobile network connection. Using mobile network user should remember as a result, you may be charged by your mobile network provider for the cost of data you downloaded or send and the duration of the connection while accessing the VibMe application. User should keep phone’s battery always charged to use VibMe application services.
Personal data is stores and processes after user of VibMe application provide it for provide VibMe application servcie. User should not jailbreak or root his/her phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. User have responsibility to keep his/her phone and access to the app secure. It could make his/her phone vulnerable to malware/viruses/malicious programs or other dangerous application or actions This can compromise your phone’s security features and it could mean that the VibMe application won’t work properly.
User have to keep in mind that Provider attempt to ensure that VibMe application is updated and correct at all times, we do rely on third parties to provide information to us so that we can make it available to you.
Provider may wish to update the VibMe application anytime. User will need to download the updates if user wants to keep using the VibMe application.
Provider is committed to ensuring that the app is as useful and efficient as possible. For that reason, we reserve the right to make changes or modification to the application or to charge for its services, at any time and for any reason. We will never charge you for services or using application in unclear way. It will be only exactly what you’re paying for.
